I hereby took it upon myself to elucidate on the above captioned issue with a view to educate the concerned members of the public and politicians alike particularly the bereaved members of the opposition APC who went to town dancing naked for judgement that didn’t benefit them in any way at all.
The PDP in 2022 filed a suit which challenged the legality or otherwise the unprecedented Yes or No Local Government election on the ground of incompetent notice of election.
The Federal High Court Osogbo in it’s well considered ruling nullified the sid notice and the election predicated on it. The APC appealed the ruling which was decided yesterday by the court of Appeal in Akure to the effect that the said suit of PDP was speculative.
It is trite and apposite to state that the said judgement made no consequential or anxiliary orders in favour of the said Yes or No election ditto for its selected Chairmen and Councillors. As expected of every sensible party to a suit in position of PDP to file an appeal against any judgement that he is not satisfied with, an appeal and stay of execution were immediately filed and served.
In thesame 2022, APP equally filed another suit against thesame Yes or No Local Government election which was also decided against APC and OSIEC nulliffying that election. APC and his co-travellers went on Appeal against the said judgement. They slept on the appeal and same was dismissed on 13/1/25 for want of diligent prosecution making the said judgement against the Yes or No election still subsisting and against the yes or no Chairmen and Councillors till today.
Mischievous minds need to be educated that Court aren’t father xmas that will give to litigants what was not asked for. There is no part of that judgement for professional mischief makers to be jubiliating about. The forthcoming Local Government election as announced and fixed by OSIEC remains sacrosanct.
The said judgement has nothing entirely to do with the coming election in its entirety. Infact am damned sure that APC will participate in the election. Lastly, in law, once an Appeal and stay of execution is filed against any judgement, it means that the status quo remains meaning the Yes or No Chairmen and Councillors remain sacked.
Let all the serious minded brace up for the election and be law abiding.
